Vance: Handful of GOP Senators Blocking SAVE America Act as Administration Eyes Parliamentarian Override

Vice President JD Vance told Newsmax that the Trump administration has examined using his constitutional authority as President of the Senate to overrule the parliamentarian and clear a path for the SAVE America Act, but a small group of Republican senators continues to stand in the way of action before the midterms.

In the interview, Vance explained that the administration has seriously considered procedural options available under the Constitution. “We’ve actually looked into this,” he said. “As the president of the Senate under the U.S. Constitution, there are things that we can do. We can take over the Senate chair. I can occupy the chair. We can overrule the parliamentarian. Those things are very possible.” The critical threshold, he emphasized, is not the traditional 60 votes needed to break a filibuster but the 50 votes required to sustain such a ruling, plus his own tie-breaking vote as vice president.

The obstacle, according to Vance, is not the bulk of the Senate Republican conference. “The problem is not the majority of GOP senators. It’s that you’ve got a few holdouts who just don’t want to do that because they’re so committed to these archaic rules.” He described those holdouts as unilaterally disarming their own side by clinging to procedural traditions that Senate Democrats would discard the moment they regain the majority. Vance pointed to the political destruction of Sens. Kyrsten Sinema and Joe Manchin after they defended the filibuster as evidence that Democratic leadership will not reciprocate restraint. “They sent a message that if you ever dare to stand against the national Senate Democrat leadership, we are going to destroy your career,” he said, arguing that the filibuster will ultimately fall regardless.

The SAVE America Act, which passed the House and remains a top priority for President Trump, would require documentary proof of U.S. citizenship to register to vote in federal elections and a government-issued photo identification to cast a ballot. It also includes strengthened rules for absentee voting and mandates that states regularly maintain voter rolls to identify and remove noncitizens. Supporters view the measure as a straightforward safeguard ensuring only eligible American citizens participate in federal elections. Senate Parliamentarian Elizabeth MacDonough previously ruled that the bill does not comply with the Byrd Rule for budget reconciliation, blocking the simple-majority path that would have avoided the 60-vote filibuster threshold.

Vance framed the standoff as a choice between protecting institutional process and securing the integrity of American elections. He argued that ending the filibuster is both the practical and patriotic course if it is the only remaining route to pass the legislation. “We need to end the filibuster to save American elections. It’s the smart and also the patriotic thing to do,” he said, warning that Democrats, if returned to power, would use the same tool to add states, pack the Supreme Court, and further weaken election safeguards.

The comments come amid ongoing pressure from the White House and House Republicans on Senate leadership to advance the bill. Trump has publicly criticized the lack of progress and called for firmer action against procedural roadblocks. With the midterms approaching, the administration’s exploration of an override option underscores the urgency attached to citizenship verification and photo identification requirements. Whether the handful of Republican holdouts will yield remains the central question determining whether the SAVE America Act reaches the president’s desk before voters return to the polls.
