WASHINGTON — U.S. District Judge Carl Nichols ruled Thursday, May 28, 2026, that Democratic plaintiffs failed to establish standing to block President Donald Trump's March 31, 2026, executive order aimed at strengthening election integrity through citizenship checks and mail-in voting safeguards.
The order directs the Department of Homeland Security and Social Security Administration to compile and share state-specific lists of confirmed U.S. citizens eligible to vote in federal elections. It also instructs the U.S. Postal Service to implement tracking and security measures for mail ballots.
Nichols, a Trump appointee, determined plaintiffs showed no current harm. "Given that the Executive Order does not command Plaintiffs to do anything, and that no agency has yet acted pursuant to the Order in a way that could harm Plaintiffs, they have not suffered any harm at present," he wrote.
The judge dismissed arguments that citizenship lists could disenfranchise voters or violate privacy. He noted inaccuracies in initial lists remain speculative, and the order requires procedures for individuals to review and correct records. Sharing of basic information like name, age, and residence among government agencies does not establish Article III standing.
