A federal Judge issued a restraining order on Saturday to block the Trump Administration from deploying National Guard to protect the Portland ICE facility. U.S. District Judge Karin Immergut sided with the state and city in their lawsuit claiming presidential overreach ruling that Trump failed to meet legal standards under the 10th Amendment and Posse Comitatus Act, emphasizing the need for further review of federal-state military balances. "Whether we choose to follow what the Constitution mandates with respect to these three relationships goes to the heart of what it means to live under the rule of law," Immergut wrote.

The order stems from Trump's September 30 memorandum federalizing the Guard to protect federal personnel and property amid escalating violence at the Portland ICE facility, where nightly protests since July have included arson, assaults, and blockades. Immergut cited "false claims" about the unrest's severity, granting the TRO for at least 14 days pending hearings, with the administration planning an immediate appeal. However, the violence is documented in countless videos shared on social media showing protesters hurling fireworks and bottles at agents, while Portland Police has refused to help ICE, even relegating normal police duties such as traffic control to the demonstrators themselves.

Violence at the South Portland ICE facility intensified over the weekend, with federal agents deploying tear gas and pepper balls Saturday against 400 protesters hurling fireworks and bottles, resulting in six arrests for disorderly conduct and assault. As seen in viral videos, Thursday's clashes led to two arrests by Portland Police of individuals who were victims of assaults by Antifa-affiliated protesters near the site; none of the actual attackers were arrested, giving the appearance that Portland Police are not only failing to assist ICE but are actively aiding Antifa. Demonstrators have been attempting to breach fencing erected after 15 arson incidents since August, which caused $5 million in damages. DHS reported over 100 assaults on agents since July, including a September 28 van ramming in Cicero.

The administration, undeterred, has indicated they will not comply with the Judge's restraining order. White House Deputy Chief of Staff Stephen Miller stated the ruling constitutes "legal insurrection," asserting President Trump's authority as commander-in-chief supersedes state objections, and described Portland as an "organized terrorist attack on the federal government" necessitating Guard protection for ICE officers facing "relentless assault and threats to life." Troops must complete training 100 miles south, slated for patrols by mid-week, per U.S. Northern Command, with DHS Secretary Kristi Noem visiting the facility Friday to affirm federal resolve despite local resistance.

Portland's sanctuary policies, reaffirmed by Mayor Ted Wheeler's July 2025 ordinance, prohibit local aid to ICE, contributing to the standoff; the city sued September 30, arguing infringement on state sovereignty, a claim Immergut partially endorsed.
