WASHINGTON — FBI Director Kash Patel filed a $250 million defamation lawsuit on April 20, 2026, against The Atlantic magazine and staff writer Sarah Fitzpatrick in U.S. District Court for the District of Columbia.

The 19-page complaint targets an April 17 article that alleged Patel has “alarmed colleagues” with episodes of excessive drinking, erratic behavior, and unexplained absences from the FBI. The story relied on more than two dozen anonymous sources. Patel’s legal team identified 17 specific “false and defamatory statements of fact” in the piece, calling it a “sweeping, malicious and defamatory hit piece” designed to destroy his reputation and force him from office.

Patel’s attorneys sent a detailed pre-publication letter refuting the claims and requesting more time to respond. The Atlantic published the story anyway after imposing a short deadline, the suit alleges. The complaint states the magazine’s journalists “crossed the legal line” by relying on anonymous sources “highly partisan with an ax to grind” who lacked direct knowledge of the facts.

Patel denied the allegations when the story first appeared and announced the lawsuit on Fox News’ Sunday Morning Futures with Maria Bartiromo, promising to fight back against what he called “fake news.”

The Atlantic issued a statement standing by its reporting and calling the lawsuit “meritless.”
