Comer Calls for Public Release of Omar Immigration File so House Can Vote on Expulsion

House Oversight Chairman James Comer said Monday night that the Trump administration should release whatever evidence it holds on Rep. Ilhan Omar’s immigration history so the House can decide whether she remains in Congress. Comer spoke on Just the News, No Noise after Homeland Security Secretary Markwayne Mullin and White House border czar Tom Homan said a federal inquiry into the Minnesota Democrat is underway. “I think they should make it public. Absolutely, make it public,” Comer said. “The evidence that I’ve seen would show that they would be privy to a lot more evidence than I would have. Most of the evidence I have is public already, anyway. So I think it should be made public, and I think the members of Congress should be the judge and the jury in this. Let us vote as to whether or not she needs to remain in Congress. If you violated the laws to become a citizen, should that make you ineligible to be a member of Congress? I think so. But put it up for a vote in Congress and let the American people see how their member of Congress would vote on that.” No House expulsion resolution has been introduced. The Constitution gives each chamber the power to expel a member by a two-thirds vote. No charges against Omar have been made public.

Mullin told podcaster Benny Johnson last Thursday that Omar “married her brother to try to bring him into the United States,” that the man now lives in London, and that investigators are also looking at “the whole family migration and possibly some illegal activity for them to come to the United States to begin with.” He called it an “ongoing investigation,” said lying on an immigration application has no expiration date, and said that if the government can prove someone should not have been admitted, “we’ll deport you.” Homan, on Sunday, described an “ongoing criminal investigation” and said ICE and Homeland Security Investigations are handling it. “I know things are going on, but I can’t give specifics,” he said. “If someone committed an immigration violation, if someone committed marriage fraud or anything like that, regardless if they’re a congressman or not, no one’s above the law.” Asked whether he was confirming an Omar investigation, Homan said, “I’m confirming that ICE is, yeah.” In August, ICE refused a Just the News FOIA for Omar-related investigative files under the exemption for records whose release could interfere with enforcement proceedings. Comer said in early September that Justice Department officials had told him scrutiny extended to “the entire Omar family.” Omar has called the brother-marriage claim false, “absurd and offensive,” and “bigoted lies.” She became a naturalized citizen in 2000 at age 17. She legally married British citizen Ahmed Nur Said Elmi in 2009 and divorced him in 2017. No court has found Elmi is her sibling. No denaturalization complaint has been filed.

In the same interview Comer said Oversight will move toward contempt against financier Leon Black, who skipped a bipartisan committee deposition last week in the Jeffrey Epstein inquiry and sued to block subpoenas seeking testimony and nondisclosure agreements with alleged victims. Black’s lawyer, Susan Estrich, called the demand a fishing expedition beyond the committee’s authority. Comer said Black is a person of interest, not an accused defendant, and that he defied a lawful subpoena. That contempt track is separate from the Omar records request. The administration has not said whether it will turn Omar files over to Congress or to the public.
